Dr Ram Manohar Lohiya National Law University Lucknow is offering another one-year ‘Post Graduate Diploma in Intellectual Property Rights (PGDIPR)’. As it is an evening programme, a working professional may join the programme and enhance their skills. The course provides in-depth knowledge of social context, historical evolution, and intellectual property rights (IPR) laws, such as copyrights, trademarks, patents, and trade secrets. It covers practical applications like new media content ownership, internet streaming, technology, software, and pharmaceutical patenting. Graduates can pursue leading positions in media, entertainment, pharmaceutical, software, and technology-based industries, as well as in traditional businesses utilizing IPR, such as FMCG and engineering conglomerates.

  • Eligibility
    • Admission to the P.G. Diploma in Intellectual Property Rights Course shall be open to those candidates who have a minimum of a graduate degree in any discipline from a University recognized by U.G.C. with not less than 45% of the total marks in aggregate (40% in case of SC/ST) and have been selected based on Written Test/Interview or any other mode of admission as may be decided by the University from time to time.
  • General Condition
    • Any candidate cannot claim admission as a matter of right, and it shall be entirely at the discretion of the University's Admission Committee for the P.G. Diploma in Intellectual Property Rights Course.
    • No candidate will be allowed to be admitted to the P.G. Diploma in Intellectual Property Rights Course if he does not fulfil the eligibility on the date of the Interview/Written Test or any other mode of admission decided by the University.
    • If two or more candidates get the same marks in the admission Written Test/Interview or any other mode of admission, then the total marks they obtained in the graduate course may be considered. Still further, if the total marks remain the same, then the candidate who is senior in age will be given preference over the others.

Intake

The total number of seats in each course subject shall not be more than 30 or as may be prescribed by the Academic Council from time to time. However, no course in any subject shall run if there are less than 15.

Reservation

Reservation to the P.G. Diploma in Intellectual Property Rights Course for the candidates belonging to SC/ST and OBC shall be by the rules prescribed by the UP Government from time to time.

Note :

  • Candidates belonging to SC/ST categories shall have to submit the recent certificate of Caste/Tribe issued by the appropriate authority of the Government of Uttar Pradesh.
  • Candidates belonging to the OBC category shall submit the recent certificate of the caste and also a certificate to the extent that the candidates do not come in the creamy layer.

Fee Structure

The fee will be charged by the University in such a manner as is determined by the University authority from time to time. Existing fee details are available at the University website as well as in the University Admission Brochure

  • The duration of the P.G. Diploma in Intellectual Property Rights course shall be one academic year.
  • The Academic Year shall be divided into Two Semesters, which shall ordinarily be between July to November and January to May, with winter break and summer vacation as may be announced by the University.
  • The classes for the course will be held in the evening at the University, as per the schedule decided by the University.
  • A candidate for the P.G. Diploma in Intellectual Property Rights shall be required to:
    • Study Five Papers - Three papers in the first semester and Two Papers in the second semester, each of 100 marks.
    • Write a Dissertation in 1st Semester, which will also continue in the second semester on the subject approved by the Head of the Department in consultation with the guide, and it shall carry 100 marks.
    • Appear in Viva Voce Examination in I and II Semesters carrying 50 marks each.

Paper 1: Foundations of Intellectual Property Rights

  • The legal concept of intellectual property and property
  • Justifications of Intellectual Property Rights
  • Intellectual property and competition issues
  • Origin and development of various Intellectual Property Rights
  • International law relating to Intellectual Property Rights, especially TRIPS and the role of WIPO.

Paper 2: Nature and Content of various Intellectual Property Rights

  • Patents: Subject matter of protection, Substantive and Procedural requirements, Issues of pharmaceutical, agriculture, biotechnology and computer programs patentability.
  • Copyright: Subject matter of protection, Concept of originality, Idea/Expression differentiation, Copyright protection for films music, databases and computer programs.
  • Trademarks: Subject matter of protection, Service marks, Certification marks, Well-known marks, Non-traditional marks, Domain name registration, Marks eligible for registration.
  • Industrial Designs: Concept of a design, Copyrightable designs, Substantive requirements, Design-Patent-Copyright overlap, Functionality doctrine.
  • Other forms of Intellectual Property: Plant variety protection, Trade secrets, Geographical indications, Data protection, Layout design protection.

Paper 3: Exercise of Ownership and Limitations/exceptions

  • Patents: Rights, Term of right, Ownership, Assignment, License, Conditions on grant, Compulsory licenses, Acquisition by government.
  • Copyright: Economic rights, Author's special rights, Right of Broadcasters and Economic Rights, Term of protection, Authorship and ownership, Assignment and License, Fair use Exceptions, Statutory License, Copyright societies, and Digital rights management.
  • Trademarks: Right, Term and restoration, ownership, honest and concurrent use, removal for non-use.
  • Designs: Design copyright, Term of right, Unregistered design protection, Ownership, Assignment, Revocation.
  • Exhaustion of Intellectual Property Rights

Paper 4: Acquisition and Enforcement of Intellectual Property Rights

  • Patents: Who can apply, Priority date, Specifications, Patent drafting, Examination, Anticipation, Pre/Post grant opposition, Grant and sealing, Patent of addition, Application through PCT route.
  • Copyright: Automatic registration, Process and drafting of application for registration, Benefits of registration.
  • Trademarks: Statutory rights and Common law, Conditions for registration, Application, Drafting and procedure for registration, Advertisement, Opposition, Effect of registration, Registration under Madrid Agreement, Registration of domain names.
  • Industrial Designs: Registration requirements, Drafting and procedure for registration, Effect of registration, Mechanism under the Hague Agreement.
  • Enforcement: Concept of infringement, Passing-off, Presumption of validity, Claims interpretation, Doctrine of Equivalents, Piracy of copyrighted work, Counterfeit trademarks, design piracy, Civil and criminal remedies under the law, Anton Pillar order, John doe Order, Mareva and ex parte injunctions.
  • Role of Enforcement Authorities: Copyright Board, Registrar his power and functions, Controller General of Patents, Design, trademark-power and functions, Intellectual Property Appellate Tribunal, Border measure enforcement and custom rules.

Paper VI: Dissertation

  • The P.G. Diploma in Intellectual Property Rights examination shall consist of two-semester examinations. In each Semester, a candidate shall be examined in the courses prescribed for that Semester in accordance with the scheme prescribed by the University.
  • The examinations for the P.G. Diploma in Intellectual Property Rights will be open to all the candidates who have undergone a regular course of study in the University and have put in not less than 70% attendance and further that the University takes no disciplinary action against the candidate.
  • The End-Term Examination will ordinarily be held in the last week of November and April for the first and second semesters, respectively.
  • An internal and external examiner shall conduct the Viva Voce Examination.
